Class Action Litigation Against Fiduciaries

The rate of litigation alleging fiduciary breach is rapidly increasing.  Past settlements with large 401(k) plans have given birth to a new wave of cases against a broader set of plan sponsors, including the first group of not-for-profit higher education institutions.  Additionally, smaller law firms are using the lessons from the first set of class action cases to replicate claims against smaller plan targets.
