Class Action Litigation Against Fiduciaries

A Multnomah Group Webinar
September 20, 2016

The rate of litigation alleging fiduciary breach is rapidly increasing.  Past settlements with large 401(k) plans have given birth to a new wave of cases against a broader set of plan sponsors, including the first group of not-for-profit higher education institutions.  Additionally, smaller law firms are using the lessons from the first set of class action cases to replicate claims against smaller plan targets.

In this webinar, Erik Daley and Richard J. Pearl will review the recurring claims against retirement plan sponsors and the steps fiduciaries may consider taking to document and to demonstrate prudence – shielding themselves against similar class action suits.

This webinar will be focused on assisting retirement plan fiduciaries in understanding the following:

  • History of class action suits against plan sponsors;
  • Recent settlement structures;
  • The new wave of plaintiffs’ claims;
  • Steps to improve fiduciary documentation and processes; and
  • Best practices related to fiduciary insurance and indemnification.

Richard J. Pearl, attorney at Drinker Biddle & Reath LLP, will provide additional insight. The webinar will conclude with a question-and-answer session.
