This year, our annual Regulatory Update features a steady stream of cases from the courts, including multiple cases making their way to the United States Supreme Court for review as well as the lingering cases against colleges and universities that began in 2016. This update also includes new guidance from the regulatory agencies, including the Department of Labor, Internal Revenue Service, and Pension Benefit Guaranty Corporation. Although landmark legislation for retirement plans was proposed in Congress this year, it has yet to make its way through both houses of Congress and to the president’s desk for signature. Plan sponsors should review the initiatives outlined within and consider how each initiative may/may not impact their plan(s).
